This document constitutes an electronic record under the provisions of the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology (Intermediary Guidelines) Rules, 2011. It is generated electronically by a computer system and does not require physical or digital signatures to be legally valid. These Terms & Conditions are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and shall operate as a legally binding agreement between the User and Homakes Ventures LLP.
By accessing, browsing, registering on, or otherwise using the Homakes Platform—including its website, mobile application, and any related services—you (“User,” “Customer,” “Seller,” or “Service Provider”) agree to comply with and be bound by these Terms & Conditions (“T&C”). The T&C outline the rights, responsibilities, and obligations of all parties engaging with the Platform and are designed to ensure transparency, accountability, and a safe environment for transactions.
The use of the Platform is subject to these Terms & Conditions, along with all policies referenced herein, including but not limited to the Privacy Policy, Refund & Cancellation Policy, and Seller Onboarding Policy. Together, these documents form the complete understanding between you and Homakes Ventures LLP. If you do not agree to these Terms, or to any policy that supplements them, you must immediately discontinue your use of the Platform and refrain from registering, transacting, or engaging with any of its services.
Your continued use of the Platform shall be considered as an ongoing acceptance of the most current version of these Terms & Conditions, including any amendments or modifications that may be introduced from time to time. Homakes reserves the right to update or revise these Terms as necessary to reflect changes in law, technology, or business practices, and it is the responsibility of all Users to review the Terms periodically.
The Homakes Platform is owned and operated by Homakes Ventures LLP, a limited liability partnership registered in India, with its registered office located at A-31, Kamdenu layout, B Narayanapura, Doorvaninagar, Bangalore, Bangalore North, Karnataka, India, 560016. These Terms & Conditions (“T&C”) set forth the legally binding agreement that governs your use of the Homakes website, mobile application, and related services (collectively referred to as the “Platform”). By accessing, browsing, registering, or otherwise using the Platform, you agree to be bound by these T&C, as well as by all policies and guidelines that are incorporated by reference.
The Platform enables Customers to explore and purchase homemade food, handmade crafts & Arts, and other home-based products and services listed by independent Sellers. Homakes acts only as an intermediary and facilitator, offering a marketplace where Customers and Sellers can interact, transact, and complete orders in a secure environment. By choosing to use the Platform, you acknowledge and accept that Homakes does not itself produce or sell the items listed, but instead provides the infrastructure necessary to support such transactions.
Acceptance of these Terms is a prerequisite to using the Platform. If you do not agree with these Terms, you must immediately discontinue use of the Platform and refrain from registering, ordering, or transacting through it. Your continued use of the Platform will be deemed as acceptance of the current version of the T&C, including any modifications that may be introduced from time to time.
These Terms & Conditions must be read in conjunction with other policies published by Homakes, including but not limited to the Privacy Policy, the Refund & Cancellation Policy, and the Seller Onboarding Policy. Together, these documents form a comprehensive framework that governs your relationship with Homakes, ensures transparency, and protects the interests of Customers, Sellers, and the Platform.
Homakes operates strictly as an online intermediary marketplace in accordance with applicable Indian laws. The Platform provides the technological infrastructure that enables Customers to discover, order, and pay for products and services offered by independent Sellers, which include home chefs, artisans, crafts makers and other approved service providers. By design, Homakes functions as a facilitator, offering secure payment systems, order management, customer support, and optional logistics services through third-party delivery partners.
Homakes itself does not manufacture, cook, prepare, or sell food, Art, crafts, or services directly. All items and services made available on the Platform are offered solely by independent Sellers, who are responsible for ensuring compliance with quality standards, safety requirements, and all applicable laws and regulations. Homakes does not provide warranties or guarantees regarding the freshness of food, the authenticity of crafts, or the reliability of services listed by Sellers. Responsibility for accuracy of listings, legality of offerings, and fulfillment of Customer orders rests entirely with the Sellers.
Commercial and contractual terms, including pricing, preparation timelines, product quality, and availability, are established directly between Customers and Sellers. Homakes’ role is limited to providing the tools to complete these transactions. While Homakes may assist in coordinating deliveries or addressing disputes through its grievance system, it is not a party to the contract between the Customer and the Seller. Consequently, Homakes shall not be held liable for delays, cancellations, defects, damages, or any service failures attributable to Sellers or third-party delivery partners.
By using the Platform, Customers acknowledge and accept that Homakes is a neutral facilitator and not the provider of the underlying products or services. Sellers remain solely accountable for their conduct, quality standards, and compliance with all applicable laws, including but not limited to food safety regulations, intellectual property protections, and consumer rights legislation.
To access certain features of the Homakes Platform, Users must create an account by completing the registration process. Registration requires users to provide accurate and up-to-date information, including but not limited to their full name, valid mobile number, email address, delivery/communication address, and payment details. By registering, Users represent and warrant that the information provided is true, complete, and not misleading in any manner. Users are required to update their account details promptly whenever changes occur, to ensure uninterrupted access and accurate communication. Homakes reserves the right to suspend or terminate accounts found to contain false, duplicate, or fraudulent information.
Users must be at least eighteen (18) years of age and legally competent to contract under the Indian Contract Act, 1872. Individuals who are classified as “incompetent to contract,” such as minors or undischarged insolvent, are not permitted to register or use the Platform. By using the Platform, Users confirm that they meet the eligibility criteria. Homakes may require verification through documents such as Aadhaar, PAN, or other government-issued identification, and may suspend accounts where eligibility cannot be confirmed.
The security of login credentials is the sole responsibility of the User. Users must maintain the confidentiality of their username, password, and one-time passwords (OTPs), and are accountable for all activities carried out through their account. Homakes shall not be liable for losses or damages arising from unauthorized access caused by a User’s failure to maintain security. In the event of suspected misuse or a security breach, Users must immediately notify Homakes so that remedial measures can be taken.
Users agree to conduct themselves responsibly when accessing the Platform. Misuse of the Platform for illegal, fraudulent, or harmful purposes is strictly prohibited. This includes uploading offensive, obscene, defamatory, or discriminatory content; infringing upon intellectual property rights of third parties; engaging in harassment, spamming, or phishing; and attempting to interfere with or disrupt the Platform’s technical operations. Users must not attempt to bypass Platform systems by engaging in off-platform transactions intended to avoid service fees. Any such conduct will be treated as a violation of these Terms and may result in suspension, termination, or legal action.
Furthermore, Users are required to comply with all applicable laws and regulations, including the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020. By continuing to use the Platform, Users acknowledge that failure to adhere to these standards may expose them to civil, criminal, or regulatory penalties in addition to action by Homakes.
Customers may place orders for food, Art, crafts, or services directly through the Homakes Platform. All prices displayed are determined solely by the respective Sellers and are shown transparently on the Platform, along with applicable delivery charges, packaging costs (if any), and taxes. Homakes does not interfere with or alter Seller pricing and acts solely as a facilitator for the transaction. Sellers retain full control over their prices, though Homakes may provide non-binding suggestions to support better pricing strategies and business growth. Customers are responsible for reviewing the final price before confirming an order, as payment of this amount signifies acceptance of the Seller’s terms.
Payments must be made in Indian Rupees through the Platform’s approved payment methods, which may include debit/credit cards, UPI, net banking, or wallet services. Homakes functions strictly as a limited payment collection agent on behalf of Sellers. Once a Customer makes payment, the amount is collected by Homakes and held temporarily until settlement is made to the Seller.
For Sellers, earnings are settled on a weekly cycle, typically every Monday, and credited directly to their registered bank account after deducting Homakes’ Platform Charges, applicable taxes, and any penalties that may arise due to verified complaints or policy violations. In cases where refunds are approved because of Seller error, such as incorrect or missing items, the refund amount will be deducted from the Seller’s payout. This ensures fairness to Customers while maintaining accountability for Sellers.
Deliveries on the Homakes Platform may be handled either directly by Sellers or through third-party logistics partners engaged by Homakes. Estimated delivery times displayed on the Platform are indicative only and may vary due to traffic, weather conditions, festivals, or other unforeseen circumstances. Customers are advised to review the delivery window at the time of placing an order and to ensure availability at the specified address during that time. If a delivery cannot be completed due to an incorrect address, unavailability of the Customer, or refusal to accept the order without valid cause, the order will be treated as fulfilled, and no refund will be issued.
Sellers are responsible for ensuring that products are packaged appropriately to minimize the risk of spillage, damage, or contamination during transit. Food must be packed in safe and hygienic containers, and crafts must be wrapped securely to withstand handling and transport. The responsibility for preparing and handing over the correct parcel to the assigned delivery partner rests entirely with the Seller.
The risk of loss or damage passes to the Customer once the order is delivered to the address provided. In cases where third-party delivery services are used, Homakes acts only as a facilitator and bears no liability for delays, damages, or theft that may occur during transit. However, Homakes may assist Customers in raising and resolving disputes with Sellers or delivery partners when such issues arise.
Orders placed on the Homakes Platform are confirmed once payment is made, and cancellations by Customers are generally not permitted except in cases where the Platform allows a cancellation option within a specific time window. For food orders, due to their perishable nature, cancellations and returns are not allowed once preparation has begun. Refunds for food are processed only in limited cases, such as when the wrong order is delivered, items are missing, or the order is not delivered at all. Customers must report such issues within twenty-four (24) hours of the scheduled delivery time through the Homakes grievance system.
Art & Craft products are eligible for return or refund if they are defective, damaged during delivery, or materially different from their description on the Platform. To initiate such requests, Customers must provide supporting evidence, such as clear photographs and, where possible, an unboxing video. Requests must be raised within seven (7) days of delivery, and the product must be returned unused, in its original packaging, and accompanied by proof of purchase. Once the returned item is received and verified, the refund will be processed in line with the applicable timelines.
Customized or made-to-order Art & Craft products are non-refundable and not eligible for return or cancellation, except in cases of verified damage or defect upon delivery. Approved refunds will be credited to the Customer’s original mode of payment within five (5) to seven (7) business days, subject to bank processing timelines. In cases where the issue is determined to be due to Seller error—such as incorrect fulfilment, verified quality issues, or packaging failures—the corresponding refund or replacement cost will be deducted from the Seller’s payout for that cycle. This ensures fair treatment for Customers while holding Sellers accountable for the quality and accuracy of their offerings.
All Sellers and Creators who register with Homakes, including home chefs, Art & craft makers, must comply with strict eligibility, onboarding, and operational requirements in order to participate on the Platform. Sellers must be at least eighteen (18) years of age, legally competent to enter into contracts under Indian law, and must successfully complete the Homakes registration and verification process. This process includes submission of valid identity and financial documents, such as Aadhaar, PAN, and bank details, to enable settlements. Food Sellers are further required to hold a valid FSSAI registration or license as mandated by law. By registering, Sellers confirm their agreement to these Terms, the Seller Policy, and all applicable laws and regulations.
Sellers are solely responsible for: preparing high-quality products; ensuring compliance with applicable food safety, health, and labor regulations; accurately describing their products on the Platform; fulfilling orders on time; and maintaining positive Customer service standards. Homakes retains the right to suspend or terminate Seller accounts in cases of repeated non-compliance, verified complaints, or fraudulent activity. Homakes may also remove listings that violate intellectual property rights, are unsafe, or do not meet quality standards.
Commission and fee structures are clearly defined during onboarding and communicated to Sellers. Homakes deducts a service fee, applicable taxes, and any penalties from each payout cycle. Sellers are expected to adhere to these terms, provide accurate banking information, and resolve disputes in good faith. Failure to comply may result in suspension, termination, or legal action as determined by Homakes.
All personal and financial information collected through the Homakes Platform is governed by the Privacy Policy. Users acknowledge that their data will be collected, stored, processed, and shared in accordance with applicable laws, including the Information Technology Act, 2000 and the rules framed thereunder, as well as the Data Protection provisions currently in force. Homakes implements reasonable measures to protect User data from unauthorized access, disclosure, alteration, or destruction, including encryption, secure payment gateways, and internal access control protocols. Users consent to the collection and use of their data for purposes related to transactions, order fulfillment, Customer service, platform analytics, marketing communications (where permitted), dispute resolution, and legal compliance.
All content on the Homakes Platform, including images, graphics, text, design elements, logos, and trademarks, is the property of Homakes Ventures LLP or its licensors and is protected under Indian and international intellectual property laws. Users are prohibited from copying, distributing, transmitting, reproducing, or creating derivative works from Platform content without prior written permission. Sellers retain rights to their original product content but grant Homakes a non-exclusive, worldwide license to display, promote, and distribute listings on the Platform for the purpose of completing transactions and marketing services.
Homakes is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Platform, the actions of Sellers, delivery delays, loss of data, or failure of services, except to the extent required under applicable law. Users agree that the Platform is provided “as is” without warranties of any kind, either expressed or implied, except as explicitly provided in these Terms & Conditions.
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to the use of the Platform, including those involving Customers, Sellers, or third-party service providers, shall first attempt to be resolved through mutual negotiation. If unresolved, disputes will be subject to the exclusive jurisdiction of courts located in Bangalore, Karnataka, India.
